“I assumed they were already in the public domain on other wine review sites and liquor store sites.”

So says Canada’s #1 wine writer, Natalie MacLean, in a statement as disturbing as it is wrong-headed. It seems that, despite seeking legal advice (where, in a bar after closing time?), MacLean is under the bizarre notion that just because copyrighted work is posted to the internet, it is thereby stripped of copyright.

Allow me to disabuse her, and everyone, of this notion once and for all.

All original work published online, whether paid for or not, from CNN.com to the humblest Tumblr, is copyright the creator, as of the moment of publication, automatically and by law.

MacLean, as you can see here, has been copiously copy/pasting reviews written by other writers into her blog and website. Previous to this going nuclear in the media towards the end of last month, the posts said “By Natalie MacLean” with only the initials of the original writer, and no link to where the reviews had first appeared. And, apparently, no permission requests whatsoever.

As PalatePress says:

Ms. MacLean’s use of others’ work clearly fails the Fair Use test because she publishes entire reviews, they are appropriated for commercial purposes and her use is not for any of the legally permitted reasons.

There is a difference between an attributed quote, which you can see here or right above this sentence, and is protected by fair use law, and an outright theft. In her defence MacLean claims that she always included the initials of the original writer…which is a bit “other than that, how was the play, Mrs. Lincoln” of her.

I’m a writer. I write for a living. That still leaves me time for several hobbies, one of which is seeking out people who have stolen my writing and posted it elsewhere without permission, attributed or not, and having their websites taken offline with no warning. And now, in case any of you also write and value your own talent and original expressions (paid or unpaid), I am going to teach you how to do it too. I wish we didn’t live in a world where you had to have these skills, but selah, we do.

  1. periodically, take the first sentence of each of your recent posts and put them in Google, in quotation marks. In the case of this post, I’d put “So says Canada’s #1 wine writer, Natalie MacLean, in a statement as disturbing as it is wrong-headed.” in the Google box. See if it brings up any posts which you, yourself, didn’t make.
  2. if so, read the posts and see if you think it’s fair use (ie they took a snippet of your post and directed the reader to your post via a link to get the rest of the info OR they then went on to discuss the point you made. Either way, a direct link to your site is indeed necessary). If it is, fine.
  3. if, instead, they have NO original content on their post at all, but instead either pretend they wrote it themselves or link to you in the (hopefully vain) hope that you’ll think that a link from an internet thief is somehow acceptable, you have my permission and encouragement to go Full Metal Raincoaster on them. We call these people sploggers, spam bloggers, when we don’t call them something worse, and wreaking vengeance upon them is easier and more polite than you think: why, even Canadians can master this!
  4. if you’re really nice, or you think there has been a simple mistake, search the website for contact details for the blogger/admin and if you don’t find any, leave a comment on the post explaining that it is your content and you are asserting your copyright, and would like it removed. If you can’t find any contact details or leave a comment, well, that’s telling, isn’t it?
  5. determine where the website is hosted. WhoIsHostingThis is the easiest tool to use, although there are plenty of others.
  6. find contact information for the web host, which is almost always easily available online (or nobody could contact them to get hosting, now could they?). If they have an Abuse email, use that. If they have a DMCA or Copyright email, use that. Here is what you email them:
  7. send a polite email explaining the situation simply. I guarantee, they get a dozen of these a day, so don’t waste their time. Say “My post HERE (link) dated X has been copy/pasted after publication to a site hosted by you HERE (other link) dated Y and I hereby assert my copyright and request to have the infringing material taken down.” If you are as mean as me, you’ll have looked around the site and may add “I believe a great deal of their content has been similarly stolen, which I am certain is against your terms of service, FYI.” Of course it’s against their terms of service: it’s against the law!
  8. if you really want to put the cherry in the Manhattan, add an actual DMCA Takedown Notice. You don’t need a lawyer for this, nor does it take more than five minutes, but it works Every! Single! Time! Poof: instant website outage! This includes some general guidelines if you feel like writing it yourself, and this is the template I myself use because I am lazy and do these a lot. Once you do one of these, there will be no stopping you.

Web hosts are legally obliged to take offline copyright-infringing content, and they don’t really give a rat’s ass how “important” the blogger is in his/her niche. If they don’t act on a DMCA notice, they risk losing their entire business, and they are not going to take that chance. That’s why this is the heavy-handed, but more productive, way of dealing with copyright infringement. It’s rare that anyone with a blog is stupid or ignorant enough to think they’re really allowed to do this, so asking them is often a lesson in fruitlessness. When their web host removes their entire site from the internet, that teaches them a lesson they won’t forget.

Now, go forth. Go forth and Google, and I raise a toast to your splogger-hunting success!

EDITED TO ADD: if you’re super-extra nasty like I am, go to the stealing site, click on their ads, not the ad itself, but the part that says “Ads by Google” or “Federated Media” or whatever, and report them there. Every ad network has a way to report sploggers, and when they confirm what you say, they will pull all their ads and probably NEVER let that person have another ad account. Hit them where they live, people!

Well everything in this list is the Avengers, and if you do all of them, nothing will hurt.

A little background: I am proud of my country. We have invented many useful household items like the zipper, the electric kettle, and the lightbulb (yes, look it up: Edison bought the patent off two Maritimers). We have also invented some less useful, even possibly noxious things, among them Nickelback and the shooter.

This is a shot glass ostentatiously filled with boozy liquids, sometimes layered, sometimes artistically sculpted, like the Brain Hemorrhage. Always with a catchy name (it’s not the taste that sells these). Think of them as the redneck cousin of the pousse cafe. They are not ordered one at a time, but by the tray, usually by fratboys or those who wish they were fratboys.

Unfortunately, we can’t take credit for the Avengers (Canada trends much more DC than Marvel), that record-obliterating hommage to spandex underwear perverts. So we’ll consider this a hands-across-the-border kind of thing: a roundup of Avengers-themed shooters.

Notice the Black Widow is mysteriously missing. That’s okay, there’s a quite palatable cocktail by that name: just mix one, and pour it into four shotglasses. Instant shooters! Today’s woman doesn’t sit around waiting to be included in a shooter roundup: she just goes out and links herself up a stiff drink.

Now, the roundup, from EXP Bar Online on Tumblr. According to them you must do these in order: Captain America, Iron Man, Thor, Hawkeye, and Hulk. Have the ingredients well chilled in advance so they layer nicely.

Captain America: Doctor Erskine was going to share blueberry schnapps with him, but he couldn’t have it. Also due to his advanced tissues on his organs can’t get drunk. Hence this shot is the weakest.

Iron man: Tony stark has battled on and off with alcoholism so his tolerance for alcohol is high hence the high proof rum, yet he tries to not drink hence the grenadine to dilute the alcohol.

Thor: He is a god. He drinks after battle and can handle his alcohol, yet human alcohol seems to affect him more hence he is the middle.

Hawkeye: Just a normal human with unbelievable accuracy with all fire arms, bow being his weapon of choice. (p.s. Unlike the trailers we here at EXP bar on line do support Hawkeye and think he is bad ass)

Hulk: He’s the hulk, as he so eloquently has stated in the past. “HULK AM THE STRONGEST THERE IS!!!!!” hence he is last.

So there you have it the avengers shot challenge. enjoy.

And the recipes (for all these drinks, you build it in the glass, pousse-cafe style. Although if you call it that, someone will puke on your shoes.

When I saw an article called 20 Ways to Fake Being a Foodie, I poured myself a cup of something strong (I think it was Irish Breakfast) and settled down to enjoy some 100% organic, free-range snark. Imagine my disappointment when the article itself turned out to be a poorly-scrambled hash of How To Fake It and How To Buy More Expensive Stuff; indeed, the article seemed designed to earnestly foster the breeding and nurture of exactly the kind of pretentious know-nothing that has given foodieism a bad name.

Leaving, of course, a gaping hole in the Snark-O-Sphere. This is like waving a red flag made of alfalfa hay and cow hormones in front of a bull, so you know what I did next: THIS!

Twenty Ways to Fake Being a Foodie: by raincoaster

  1. Take pictures of everything that you eat, no exceptions. That means everything from your morning coffee, which you will refer to as “petit café” right through to the last shot of rotgut you take before passing out in front of the tv. Bonus points for doing it with an SLR rather than an iPhone. Double bonus points if you change lenses first while your food gets cold.
  2. Instagram that shit so nobody can tell what it really looks like anyway.
  3. NEVER refer to a food, even English food, by English words. And don’t use Italian words when you can use French or Japanese. It’s not zucchini; it’s courgettes. Bookmark Babelfish for the purpose: SO handy for translating “Cream of Wheat” into Icelandic and tweeting out the result.
  4. Cross-post all these pictures to every social media platform under the sun. Do not add anything new to any of the cross-posts. If someone wants to follow you on Twitter and be friends on Facebook, it must be because they want to see these things repeatedly, amirite? Have a blog; that should go without saying.
  5. Claim to have originated the recipe for things which need no recipes, and put those recipes into blog posts which are then shared to all platforms in number 4. A good example would be a post that starts with, “I’m often asked by my [imaginary] friends for my killer recipe for ‘Sandwich à beurre d’arachide avec la confiture,’ so after much prodding I’ve decided to share the secret…”
  6. When dining with others, physically interpose yourself between them and their food until you’ve composed and photographed it to your satisfaction. They will feel special.
  7. Namedrop chefs who’ve appeared in Vogue, but not those who’ve been nominated for James Beard Awards.
  8. Describe your groceries as “hyperlocal” because you buy them at the Safeway down the street.
  9. Describe your groceries as “organic” because, hello, they’re not made of noble gas compounds, are they?
  10. Describe your dinner party hors d’oeuvres of white toast and Cheez Whiz as “brushetta.”
  11. Spell it like that.
  12. Ostentatiously disdain and abuse one restaurant that you will never be able to afford. In advance. That way you don’t have to come up with excuses when you get invited there with friends.
  13. Buy one bottle of super-premium olive oil. When it runs out, refill it with cheap olive oil bought because it was a similar colour.
  14. Serve cheap wine in expensive glasses. Be sure the napkin around the label doesn’t slip. When someone questions the wine, say it hasn’t breathed enough, but you wanted to share “something really special” with your friends.
  15. Don’t forget that time is precious when preparing for a dinner party. Pick up the stuffed loin at Costco and pretend you slaughtered the beast yourself “on Papa’s ranch.” That Papa’s ranch is the Rancho Vista Senior’s Center need not concern your guests.
  16. Introduce yourself to the staff whenever you go out. Follow them into the kitchen and introduce yourself to everyone there. It’s so endearing, and they will never forget you.
  17. Tip 10%. It keeps people on their toes.
  18. Refer to the time you spent bagging groceries in high school as “my early culinary training.” Better yet, upgrade it to “doing a stage with Famous Chef.” He need never know. He probably wouldn’t remember your name if you had.
  19. If you really, truly, cannot make any palatable food whatsoever, but people are coming over expecting to be bowled over by your cuisine (because you’ve been following tips 1 through 18) buy a metric shit-ton(ne) of fruits and green, leafy vegetables, bung the lot into a blender, and serve in milkshake cups, explaining you’re “over the macrobiotic thing, and really into Living Foods juicing now.”
  20. If you have accidentally invited any actual raw vegans, fold immediately, you have met your match in pretention. How can you tell a raw vegan? Oh they’ll tell you!
